Maha Club, Canggu, Bali Seeks to Clarify Issues on Land Use and Noise Pollution.

As reported in a follow up article published on RadarBali, Selma – a lawyer from a legal team representing the Club, has voiced objections and requested the “right of reply” regarding several news reports and social media posts by *Radar Bali*, arguing that that the coverage failed to fully reflect the actual situation.

​In its formal letter of objection,, the Maha Club Canggu’s Legal Team addressed several points, ranging from the legal status of the surrounding environment and the impact of sound control measures within a 50-meter radius of the Club, to allegations of misuse of agricultural lands, and the failure to verify these matters before publication.

​The Maha Club Canggu specifically addressed the article on Radar Bali, which served as the source for coverage published by Bali Discovery and related social media reports about enforcement measures taken by the Badung Public Order Agency (Satpol PP) concerning the venue’s operations.

​Regarding the 50-meter radius noise pollution violations: The Maha Club’s Legal Team stated that, based on their internal mapping, the area within that radius does not include residential settlements. The team of lawyers noted that the area surrounding the location is predominantly occupied by business and commercial establishments,  such as restaurants, convenience stores, and other tourism-related enterprises.

​Accordingly, the Maha Club’s Legal Team requested a review of published narratives claiming the venue is situated within 50 meters of residential housing, urging that the actual on-the-ground conditions be taken into account.

​The Maha Club also clarified its noise-control measures. That clarification stated that the Club’s management has implemented sound control systems as part of its operational procedures. The audio system is reportedly equipped with sound-control devices set to limit maximum sound emissions to 15 dB, well below the 70 dB limit set by local regulations.

​Land Zoning Violations: The Maha Club’s Legal Team also took issue with linking noise complaints to alleged violations of zoning permits or land-use specifications. According to the Maha Club Legal Team, noise issues and land zoning are distinct matters that should be evaluated on their own facts and legal grounds.

​The team of lawyers maintains that complaints about noise levels should not automatically serve as a basis for concluding that there has been a violation of zoning regulations or land-use permits. Consequently, the Maha has requested that these two issues not be conflated without proper verification and clarification.

​Beyond the report’s substance, the Maha Club’s Legal Team also questioned the confirmation process undertaken before publication. They urged that information that could affect the business entity’s reputation be verified beforehand and that the party being reported on be allowed to explain.

​Right of Reply: In its letter, The Maha Club requested that Radar Bali review the coverage deemed inconsistent with the facts, provide proportionate space for clarification and/or a right of reply, and refrain from elaborating on information they consider unverified.

​The Maha Club’s Legal Team also requested correction of online posts related to the coverage within 24 hours. Furthermore, they requested written confirmation of the follow-up actions to be taken in response to the objections raised, threatening legal steps “if no resolution or adequate follow-up is reached within the requested timeframe.”

​The Maha Club Legal Team said it hoped the matter regarding the news coverage could be resolved professionally and proportionately, while also allowing The Maha Club to clarify the information previously reported.
